About Fork It!

These Terms of Service ("Terms") govern your use of Fork It! ("Fork It!," the "Service," or the "Site"). By using Fork It!, you agree to these Terms. If you do not agree with them, please do not use the Service.

Fork It! is a restaurant decision tool designed to help individuals and groups choose places to eat based on location and selected preferences.

Fork It! is intended to simplify the decision-making process. Restaurant selections are suggestions, not guarantees or endorsements.

Using Fork It!

You may use Fork It! for lawful, personal purposes.

You agree not to:

• Attempt to interfere with or disrupt the operation or security of the Service;
• Attempt to gain unauthorized access to accounts, systems, or data;
• Use automated systems to scrape, harvest, or systematically extract restaurant or other data from the Service;
• Circumvent technical restrictions or security measures;
• Use the Service to engage in unlawful, fraudulent, abusive, or harmful activity; or
• Use Fork It! in a way that violates the rights of Fork It!, its service providers, or others.

We may modify, suspend, limit, or discontinue some or all of the Service when reasonably necessary.

Accounts

Many Fork It! features can be used without creating an account.

If you create an account, you are responsible for maintaining the confidentiality of your login information and for activity occurring through your account.

You agree to provide accurate information and not to impersonate another person.

You may delete your account through the functionality provided by Fork It!. Account information and saved favorites will be handled as described in our Privacy Policy.

We may suspend or terminate accounts that are used to abuse the Service, violate these Terms, or interfere with other users.

Restaurant Information

Restaurant and place information displayed by Fork It! is obtained from third-party data providers, including Foursquare.

We make reasonable efforts to present useful information, but we do not guarantee that restaurant information is complete, accurate, current, or error-free.

Restaurant names, addresses, categories, websites, operating status, and other information can change without notice.

You should confirm important details directly with the restaurant before visiting, particularly information such as location, operating hours, availability, accessibility, dietary accommodations, and other information that may affect your visit.

A restaurant appearing in Fork It! does not mean that the restaurant sponsors, endorses, or is affiliated with Fork It!.

Restaurants cannot pay Fork It! to be selected by the restaurant picker.

Location Information

Fork It! uses location information that you voluntarily provide to find restaurants near you.

You may provide your location through your browser's location feature or enter a location manually.

Location information necessary to perform a restaurant search may be provided to third-party services used to perform that search, including Foursquare.

Group Pick

Group Pick allows multiple participants to provide restaurant preferences so that Fork It! can suggest a restaurant based on the group's selections.

Group Pick is intended as a decision-making aid. We do not guarantee that the restaurant selected will satisfy every participant or every preference.

Group results depend on the preferences submitted by participants, the search criteria selected for the group, and restaurant information available through our third-party data providers.

Users are responsible for sharing Group Pick links or codes only with people they intend to invite.

Group Pick information is temporarily retained and automatically deleted as described in our Privacy Policy.

Favorites

If you create an account, Fork It! may allow you to save restaurants to a favorites list.

Favorites are provided for convenience. Saving a restaurant does not guarantee that its information will remain unchanged or that the restaurant will continue operating.

You may remove individual favorites or delete your account as provided by the Service.

Feedback and User-Submitted Content

If you submit feedback, comments, suggestions, or other content to Fork It!, you agree not to submit content that is unlawful, threatening, abusive, defamatory, infringing, malicious, or otherwise inappropriate.

We may review, retain, or delete submitted feedback as reasonably necessary to operate and improve the Service.

Feedback submitted through the feedback feature is not intended to be publicly displayed.

If you voluntarily provide suggestions or ideas about Fork It!, you allow us to use those suggestions to improve or develop the Service without an obligation to compensate you.

Third-Party Services and Links

Fork It! relies on third-party services, including Foursquare, to provide restaurant and location information and may link to external websites or services.

Fork It! does not control third-party websites or services and is not responsible for their availability, content, privacy practices, terms, or actions.

Your use of a third-party service is subject to that provider's own terms and policies.

Intellectual Property

Fork It!'s name, branding, design, software, original content, and other materials created for the Service are owned by Fork It! or its operator unless otherwise stated.

Restaurant names, trademarks, logos, and third-party data remain the property of their respective owners.

Nothing in these Terms grants you ownership of Fork It! or third-party intellectual property.

Disclaimer of Warranties

Fork It! is provided on an "as is" and "as available" basis to the fullest extent permitted by applicable law.

We do not guarantee that the Service will always be available, uninterrupted, secure, or error-free.

We also do not guarantee the accuracy or availability of restaurant information or that any restaurant selected by Fork It! will meet your preferences or expectations.

You are responsible for deciding whether to visit, contact, purchase from, or otherwise interact with any restaurant.

Limitation of Liability

To the fullest extent permitted by applicable law, Fork It! and its operator will not be liable for indirect, incidental, special, consequential, or similar damages arising from or related to your use of, or inability to use, the Service.

This includes claims arising from restaurant information, restaurant selections, third-party services, or your experience with a restaurant.

Nothing in these Terms excludes or limits liability where doing so would be prohibited by applicable law.

Changes to the Service or These Terms

We may modify Fork It!, add or remove features, or discontinue parts of the Service from time to time.

We may also update these Terms. When we do, we will update the Last updated date at the top of this page.

Your continued use of Fork It! after updated Terms become effective constitutes acceptance of the updated Terms.

Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict-of-law principles, except where applicable law requires otherwise.
